Leases & Evictions:

Understanding Your Rights and Protecting Your Property.

We understand how difficult the leasing and eviction processes can be. We assist tenant or landlords - alike. The attorneys at LDG, PLLC are ready to fight for your respective rights to the subject property.

TENANT

  • A lease is a legally binding contract between landlords and tenants. Lease agreements should include specific information regarding the tenants, the subject property, the lease term, monthly rent amount and due date, the security deposit (if applicable), maintenance and repairs and so on.

  • Reviewing a lease on your own could become frustrating or confusing due to complex terms. Having an attorney review your lease agreement ensures the terms are evaluated by professionals with an understanding of legal jargon.

  • As you know, the lease agreement should include specific information regarding the tenants, the subject property, the lease term, monthly rent amount and due date, the security deposit (if applicable), maintenance and repairs and so on. These terms may be negotiated verbally or by written communications. The leaser might be more receptive to negotiating terms with a licensed attorney opposed to a potential leasee.

  • The eviction process has been initiated. A Notice to Vacate is a formal written letter from a landlord to tenant stating the lease agreement has been violated, rent has not been paid, or illegal activity has been taken place in or on the property and the landlord provides a time frame for you to move out.

Should you refuse to move out, the landlord may file a lawsuit to have you removed from the property. Negative consequences of an eviction lawsuit such as damage to your credit score and/or rental history could effect your personal life for a long time.

Our attorneys at LDG, PLLC are here to provide support during this process should you find yourself served in a eviction lawsuit.

LANDLORD

  • Leases are legally binding contracts between you and your tenants. The lease agreement should include specific terms such as: the tenants, the subject property, the lease term, monthly rent amount and due date, the security deposit (if applicable), maintenance and repairs, etc.

Our attorneys are trained in professional document drafting. Our priority is to ensure the terms of lease agreement are clear, fair and legal.

  • Should a tenant violate their lease agreement, fail to pay rent, or engage in illegal activity at your property- you are entitled to initiate the eviction process. You are required to provide the tenant with a written Notice to Vacate that outlines the date the tenant needs to move from the property.

If the tenant does not comply with the notice to vacate, the next step is filing a lawsuit with the courts. This legal process can be very meticulous. Our attorneys can confidently navigate through this legal process with the court to provide you piece of mind.
